I realize KIDS need a place to practice and get started.

But what about ADULTS who have a garage band as a hobby? That like to play nearly every weekend?

The bass is the real problem. You cannot drowned out the bass with fans, noise machines or even the television. It permeates through everything and is getting to be really frustrating.

Already talked to the offending resident on a couple occasions. Their adjacent neighbor has moved out and rented her house...but the renters told us they are fed up and ready to move out. No opinion sought from other neighbors. I personally am tired of this noise pollution. Seems like they would be required to do some kind of sound proofing on THEIR house/garage-turned-livin g space. BOOM BOOM BOOM goes the bass, THUMP THUMP THUMP goes the drums...THROB THROB THROB goes my head - because I can't sleep because of the noise.

Already tried talking to the resident. They don't care who they disturb. Cannot bring myself to call the police on them anymore. I am so tired of thoughtless, selfish, NOISY neighbors and a City ordinance that isn't enforced. (remember barking dogs? I didn't think it could get worse...but it did).

If they are making too much noise for you to sleep after 1100 call the PD. If the PD does nothing call the city manager the very next day. If you don't do that then you might as well go have a beer with them.
A good plan violently executed now is better than a perfect plan executed next week.

Our neighbors have a garage band going sometimes. Usually it is the son and his friends although I haven't heard them lately. We can only hear them if we are in the garage so we have no problem with it. They did ask us if it bothered us so they were very neighborly about it. I can only suggest using floor fans at night if it bothers your sleep time. I started that years ago when my husband stayed up later than me and had the t.v. volume on high! Good luck with this. If you have a remedy for barking dogs next door, please share!

mspam3 - I think I have heard the band playing during the day when I go up to school to get my son. I haven't heard them in the last couple months so maybe they're in college now?

I haven't talked to my neighbor for a while, but I haven't heard them playing and there haven't been any cars parked out front. In fact, I haven't seen the son in some time so maybe he moved away. I am not sure.

I wish my neighbor would MOVE. Still playing strong and louder than ever. I believe since I started calling the police he has started playing louder...then I call the police again...and not on weekends anymore! Pick a night and he and his friends are jamming loud enough to compete with the new Allen Entertainment Center (or whatever it's called). I don't think the police are responding to my phone calls anymore. I hate to be a whiney neighbor, but I do consider myself a courteous neighbor. If a neighbor of mine (except for him) came to me with a problem, I would do just about anything to avoid future irritations. I'm not at all impressed with COA's ability to enforce their ordinances. Maybe it IS time to move.

I wouldn't know how to go about that. Besides, based on previous dealings with the City, complaints fall on def ears. My belief is that I lack sufficient prestige and influence to be heard or helped.

My hope was that somebody might read this that had a similar experience and could offer some glimmer of hope and direction because of a situation that was peacefully resolved.

I actually DO have some experience with barking dogs...after being ignored by the police and by Animal Control - I emailed every city council member. I got a call and an email the next day from the police department. Didn't do me any good. Went through their processes only to find out that they had lost our paperwork, yes paperwork - the complaint we filed. In the end, the city attorney dismissed our case, even with video tape of the constant barking. However, after installing a surveillance camera in a tree that looked down on our neighbors backyard to gather evidence - only THEN did the neighbors take action to quiet their four beautiful dogs. We've since taken the camera down. Not a very nice thing to do on our part, but we tried talking to our neighbor so many times...

As for the garage band...during the summer I use a fan on high - but it makes the bedroom cold and drafty with winter now officially here. I bought a humidifyer to replace the noise of the fan. But the repetative beat penetrate my best attempts to cover it. No rest for the weary.

Does your neighborhood have an HOA? An HOA might actually be more effective long term. Hit them in the pocket book.

There is no time on noise complaints. You can make them any time day or night.
I don't suffer from insanity. I enjoy every minute of it!

Surely they're bothering other neighbors as well. Maybe get a few of them and all of you go and speak with the noisy neighbor together. And if that doesn't work, then maybe all of you could take the situation to the council.

Then perhaps a letter delivered to the noisemaker and signed by every one that is being disturbed.

I've thought about a petition or something along those lines. I don't feel "safe" about going to the mans house with neighbors in tow. Hard enough to go over there on my own to tell him there was a problem in the first place. He already retaliates by cranking up the music after the FIRST visit by the police. I don't understand how he can continue to play so loud in a neighborhood without any consequences.

The neighbors directly behind and beside this man will not complain - one neighbor is a sweet elderly couple and the other neighbor is a non-English speaking family. Neither want any "trouble".

I'm on my own. I'll just continue to call the police and hope that things don't escalate.

I would research city noise ordinances and city/county/state nuisance laws. Maybe talk to a lawyer. Even a couple $5,000 small claims court losses can make someone think. You may never collect unless the court let you put a lien on the house. If they are renters, the owner might not renew their rental if HE/SHE has to pay the fines or risks losing all their investment. I suppose if the amount owed you got big enough, maybe the court would just let you take the house and then make them move!! I'm sure the owner wouldn't like losing their house but still have to pay a mortgage on it.

I could see you standing in court for the 20th time asking the court, "I have liens on this property for 19 other $5,000 judgements. The judgements now exceed the value of the house. I request the court to execute a deed of the property to me in payment of the judgements".

You are correct about the 2300 cut off. It does not exist in the city code. Maybe it's the HOA "rule" or maybe I am confused. I was sure it was a city ord though.

Allen doesn't enforce their ordinances if requested to do so by a resident of the City. You must be a code enforcement officer, police officer, or other City official. Case in point, I recently spent thousands of dollars to have my house painted and had not yet replaced the numbers on the garage...it was no time until I got a letter saying do it or be cited. Does every house down the alley have numbers?? Of course not, and still don't. You jump through all the hoops, file all the paperwork (tends to get lost) gather your own evidence, go to court, but in the end you are fighting the City to enforce an ordinance, not the resident that is violating the ordinance. Allen's chosen City Attorney is a joke...don't expect any assistance from him (them), they are against you, not for you.

This could be my neighborhood, where this is a big problem. Calls to report will get a mixed result, but should be done. And my personal experience after being made fun of for calling in stuff, is to get neighbors to share the reporting so your name isn't the only one they hear from.
